The European Securities and Markets Authority (ESMA) has released two new consultation papers on guidelines under markets in crypto assets regulation (MiCA):

– Reverse solicitation guidelines: ESMA is soliciting feedback regarding reverse solicitation and supervision practices;
– Classification of crypto-assets: ESMA seeks input on defining clear criteria for categorizing crypto-assets as financial instruments. Guideline 8 sets out the proposed conditions and criteria for identifying crypto-assets as NFTs.

These consultations close on April 29, 2024. ESMA will review the feedback in Q2 2024 and aims to publish the final report in Q4 2024.
